Terms of Service

Article 1 - Preamble and Purpose 

The Geological Adventure mobile application (hereinafter “the Application”) is published by the Departmental Council of the Alpes de Haute-Provence (hereinafter the “Editor”). It is intended for the general public who wish to discover the great landscapes and the wealth of heritage present on the cross-border territory, between the Alpes de Haute-Provence and the province of Cunéo (hereinafter the “Users”). 

The purpose of these General Conditions of Services is to govern the relationship between the Publisher and the Users using the Application. 

The User acknowledges having read these general conditions of service before downloading the Application.

Downloading and installing the Application on his phone by the User implies unreserved acceptance of these general conditions of service as defined below, accepting them and respecting them.

Article 2 - Prerequisites

Technical prerequisites:

In any case, the User remains responsible for his IT environment and the compatibility of his equipment with the Application.

Download and create an account:

Downloading the Application is free. It is done from the App Store or the Google Play Store.  

Removal of the Application:

The User is free to delete the Application by uninstalling it from his phone at any time, free of charge.

Article 3 - Description of the functionalities of the Application

Services available from the free version of the Application:

The Application gives access to the courses free of charge. 

The User can thus follow a GPS track and display geolocated information of a route.

He will have access to information in the event of technical difficulties. He will be informed of the quality of the GSM network at each point of interest noted.

The User can save in the Application memories of his journey: photographs, voice or written notes… and can share his journey log with his acquaintances via social networks.

After the hike, the User evaluates the route he has taken.

Users will benefit from automatic course updates free of charge. However, their content and frequency are in no way guaranteed.

Services available from the Site:

The User can also access certain services from the Site in addition to those offered on the Application and in particular buy a route, display / manage his race log, display / search for a route. 

Warnings: 

The User is warned that certain functionalities require network access.

Likewise, in the absence of a GPS signal, it is no longer possible for the User to be guided on the route but the map display remains active. 

Finally, the User's attention is drawn to the fact that the GPS signal is precise to more or less 10 meters, it is therefore up to the User to measure the risks associated with such a technical limit.

The Publisher does not commit to the accuracy and precision of the information in the Application, in particular as regards the accuracy of the base maps, some trails may not appear there, as well as information relating to the remaining time and at altitude, which are only approximate and indicative.

Article 4 - Intellectual property

Are the property of the Publisher and subject to the laws governing intellectual property, in particular the layout, structure and graphic and textual elements of the Application.

Use of the Application does not confer any rights on Users other than the use of the Application as defined in article 3 hereof.

Consequently, Users may not under any circumstances and in any way reproduce, represent, distribute, market, copy, translate, adapt, extract and / or decompile all or part of any of the elements reproduced on the Application. and all or part of the Application in general, without the prior and express consent of the Publisher, except for the content from which they originate. 

It is expressly understood that by posting content through the Application, the User acknowledges that said content is likely to be distributed to all users of the Application and visitors to the Site.

In particular, the User expressly acknowledges and accepts that the evaluation and comments given on the route will be distributed freely on the Site and the Application and accessible to all users of said services in order to feed the User Community. 

Regarding the memories of the hikes (photographs, comments, etc.), the User may freely decide to keep this information in his personal space to which access is reserved for him or to put said content online on the Site and the Application for make them accessible to the User Community and / or on the social networks of their choice.

The User thus grants to the Publisher for the whole world and the entire term of copyright protection, the right to reproduce, modify, represent said content on the Application, on the Site, without any financial compensation, this that the User expressly recognizes.

In addition, the User declares and guarantees that he is the owner of the content that he puts online and that they are free of all rights, or, at the very least, that he has the necessary rights for their distribution through of the Application, of the Site.

The User also undertakes that each person represented has given their consent for the use and dissemination of their image and releases the Publisher from any possible third party claims against them due to the violation of their rights.

Article 5 - Personal data 

There is no personal data collected by the Application.

The data collected is only anonymous usage data.

Article 6 - Respect for private life

The Publisher pays particular attention to the protection of the privacy of Users. Thus, Users are informed that they can deactivate the geolocation function at any time but are however informed that this will result in making some of the services offered by the Application inaccessible.

Likewise, Users can erase their journey history at any time.

ARTICLE 7 – FORCE MAJEURE

Any non-performance by the Editor of any of its obligations due to the occurrence of an event of force majeure, namely an external, irresistible and unforeseeable event, which prevents or makes the performance of the obligation unusually difficult. in question, will not engage its responsibility.

Article 8 - Non-waiver

The fact, for the Publisher, of not applying, not requiring the application or not taking advantage of any of the provisions of these general conditions can not be interpreted as a waiver to subsequently invoke this provision. or any other.

Article 9 - Modifications of these general conditions of service

The Publisher reserves the right to modify the provisions of these general conditions of service at any time and without notice. 

Users will be bound by these modifications and must therefore periodically verify whether their use of the Application complies with the provisions of the general conditions of service according to the version in force.

Article 10 - Applicable law, jurisdictional competence and independence of clauses

These general conditions of service are subject to French law. 

In the event of a dispute concerning in particular these general conditions of service or the use of the Application, the jurisdiction is that of the French courts. The competent court will be appointed according to the procedural rules in force in France.

In the event that one or more stipulations of these conditions should be held to be invalid, the validity of the other stipulations cannot be called into question unless they were inseparable from the invalidated provision.
